This agreement is between you and Kodehort Ltd (“Kodehort”, “we”, “us”), a company registered in England and Wales. It covers the Spacetile app for macOS, its updates and its documentation (together, “Spacetile”). Installing or using Spacetile means you accept it. If you don’t accept it, don’t install or use Spacetile.
Buying a Licence is covered by our Terms of sale. The source code in the public repository is covered by the Source licence instead.
The Trial
Every install of Spacetile starts with a 14-day Trial, with every feature on. When the Trial ends, tiling and profiles stop until you enter a Licence key. Your windows stay where they are, and the menu bar, Settings and the buy and activate flow keep working.
The Trial is for judging whether Spacetile suits you. Resetting it, or reinstalling to start it again, isn’t allowed.
Your Licence
A Licence is a personal right to use Spacetile. Kodehort grants it to the person whose email address it was issued to. It is non-exclusive and non-transferable.
With a Licence you may:
- install and use Spacetile on every Mac you use yourself, whether you own it or your employer does;
- install and use every release made during your Licence’s update window; and
- keep using any release made during your update window after the window closes.
Your update window is the 12 months after you buy your Licence, or lifetime if you bought Lifetime supporter. A lifetime update window covers every release Kodehort makes and never closes. A Renewal adds another 12 months to a 12-month window: from the end of your current window if you renew before it closes, or from the date of the Renewal if you renew after. Releases made after your update window closes need a Renewal.
A Licence obtained without payment, such as one given to a reviewer, carries the same rights as a bought one, for the update window it was given with.
Licence keys
Your Licence key proves your Licence to the app. It contains your email address, so keep it to yourself. You must not share it, publish it or let anyone else use it.
Spacetile verifies your key on your Mac. It never contacts us to check it.
What you must not do
You must not:
- copy, sell, rent, lend, share or distribute Spacetile, or a Licence key, except as this agreement or the Source licence allows;
- remove, disable, bypass or otherwise circumvent the check of your Trial or Licence, or use a copy of Spacetile in which someone else has done so;
- create Licence keys, or use one that Kodehort didn’t issue to you; or
- remove or change any copyright or licence notice in Spacetile.
You may reverse engineer or decompile Spacetile where the law gives you that right and it can’t be excluded by contract. The source is public, so you shouldn’t need to.
Revoking a Licence
We revoke a Licence when we refund it, as our Refund policy describes. We may also revoke a Licence if its key has been shared or published, or if you break this agreement. Releases made after the revocation refuse its key. A release you already have keeps working, but your right to use Spacetile ends when we revoke your Licence.
Updates
Spacetile checks for updates and offers new releases. Installing them is up to you. A release made outside your update window is shown with a Renew button and won’t install until you renew.
Ownership
Kodehort and its licensors own Spacetile and all intellectual property rights in it. You get a licence to use it, not ownership of it.
Spacetile includes third-party components under their own licences, such as Sparkle and code adapted from WhichSpace, both under the MIT licence. Those licences apply to those components.
Ending this agreement
You may end this agreement at any time by deleting Spacetile. It ends automatically if you break it, or if we revoke your Licence. When it ends, you must stop using Spacetile and delete it.
Your legal rights
If you’re a consumer, you have legal rights that this agreement doesn’t affect. In the UK, the Consumer Rights Act 2015 requires digital content to be as described, fit for purpose and of satisfactory quality. If Spacetile isn’t, you may be entitled to a repair, a replacement or a refund. Citizens Advice can tell you more about your rights.
Liability
We aren’t liable for any loss or damage that wasn’t foreseeable when you accepted this agreement. If you use Spacetile for business, we aren’t liable for lost profit, revenue, business or data, and our total liability to you is limited to the amount you paid for your Licence and any Renewals.
Nothing in this agreement limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn’t allow us to limit.
Changes
We may change this agreement. The version in force when you install a release applies to that release. We’ll show the date of the last change at the top of this page.
Law
The law of England and Wales governs this agreement, and the courts of England and Wales have jurisdiction over any dispute about it. If you’re a consumer living elsewhere in the UK or in the European Union, you keep the protection of your local consumer law and may also bring proceedings in your local courts.
